Terms & Conditions

DRAFT – these terms are a skeleton and must be reviewed by a lawyer and adapted to your specific business model (marketplace vs. seller, withdrawal, delivery) before go-live.

§ 1 Scope & provider

These terms apply to orders placed via the Lieferking platform, operated by LTA Gastro Solutions GmbH, Krummspät 78, 26810 Westoverledingen, Germany. Clarify and describe the platform's role (intermediary/marketplace or seller).

§ 2 Contracting party & conclusion of contract

With whom is the contract concluded (platform or partner restaurant)? Describe how the contract is formed (order = offer, acceptance by …).

§ 3 Prices & payment

All prices include statutory VAT plus the delivery and service fees shown. Payment is made via the methods offered during checkout (e.g. cash on delivery, card via Stripe). Add due dates, payment default, vouchers, etc.

§ 4 Delivery & availability

Describe delivery areas, (non-binding) delivery times, minimum order value, and the process for unavailability/cancellation by the restaurant.

§ 5 Right of withdrawal

For the delivery of perishable goods or prepared meals, the right of withdrawal is generally excluded under § 312g(2) no. 1 of the German Civil Code (BGB). Review the exact scope and add a withdrawal notice for any non-exempt services.

§ 6 Warranty & liability

Statutory warranty; liability limitations to be drafted by a lawyer.

§ 7 Dispute resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 8 Final provisions

German law applies. Add severability clause, place of jurisdiction, etc.
